Overview of Scale AI v. Eugene Ling and Mercor
Scale AI, which specializes in providing AI training data, has filed a lawsuit against its former employee Eugene Ling and rival company Mercor, accusing them of industrial espionage and misappropriation of trade secrets.
Basic charges
Scale AI accuses Ling and Mercor of stealing over a hundred confidential documents containing customer strategies and sensitive information, and these documents were uploaded immediately after a meeting with Mercor's CEO. The lawsuit refers to Ling's attempt to acquire an important customer known as "Customer A" while working for Scale, as well as his attempts to recruit employees from the company to move to Mercor.
Scale AI's demands
Scale AI is seeking to stop Mercor from using any of the stolen information and returning the documents, as well as to cover legal costs and damages resulting from the alleged breaches.
Mercor and Ling's defense
Mercor denies using any data from Scale, explaining that the documents were saved on Ling's personal Google Drive and did not reach the company, and that it offered a solution to destroy the files six days ago, but Scale did not respond to the offer. Eugene Ling denied that he intended to cause any harm, emphasizing that he requested guidance before any action was taken on the files and that he did not use the documents in his current role.
The broader context
The AI industry is characterized by intense competition and the constant transfer of talent and sensitive information between companies. This comes against the backdrop of Scale AI, which saw a massive investment from Meta of $14-15 billion for a 49% stake, and the company recently announced layoffs of about 14% of its employees as part of a restructuring.
